# BST Private Gym — "Deadly Dozen Simulation"
## Waiver, Release of Liability & Assumption of Risk

**Organiser:** BST Private Gym (Pty) Ltd / sole proprietor trading as BST Private Gym ("BST", "we", "us")
### 1. Assumption of Risk
I understand and acknowledge that:
- Participation in high-intensity functional fitness training and competition — including Olympic weightlifting, gymnastics movements, plyometrics, sprinting, and timed/scored workouts under fatigue — carries an inherent risk of injury, including but not limited to muscle strains, sprains, fractures, dislocations, cardiovascular events, and in rare cases, permanent disability or death.
- These risks exist even where equipment is well-maintained, instruction is competent, and safety protocols are followed, because the activity itself is physically demanding and performed under time pressure and competitive conditions.
- I am voluntarily choosing to participate with full knowledge of these risks.
- BST coaches and staff will provide instruction, movement standards, and scaling options, but cannot eliminate the inherent risk of the activity, and I remain responsible for working within my own physical limits and reporting any pain, dizziness, or discomfort immediately.
### 2. Release of Liability & Indemnity
In consideration of being permitted to participate in the Deadly Dozen Simulation, I, the undersigned participant, agree as follows:
**2.1** To the fullest extent permitted by law, I release, discharge, and hold harmless BST Private Gym, its owner(s), coaches, staff, contractors, and the venue, from any and all claims, demands, actions, or liability for personal injury, illness, death, or property loss or damage arising out of or connected with my participation in this event, **except** where such injury, illness, death, or loss arises from the **gross negligence, willful misconduct, or fraud** of BST, its owner(s), coaches, or staff.
**2.2** I understand that South African law (the Consumer Protection Act 68 of 2008) does not permit BST to exclude liability for gross negligence, and nothing in this waiver attempts to do so. This waiver excludes liability only for the ordinary, inherent risks of a strenuous physical activity described in Section 1.
**2.3** I agree to indemnify BST against any claim brought by a third party arising from my own negligent or willful act during the event.
**2.4** This release binds my heirs, executors, and legal representatives.
### 3. Medical Fitness Declaration
I confirm that:
- I am medically fit to participate in strenuous physical exercise and am not aware of any medical condition, injury, or physical limitation that would make participation unsafe, **except as disclosed below:**
- I have consulted a medical professional if I have any pre-existing condition (cardiac, respiratory, musculoskeletal, or otherwise) that could be affected by strenuous exercise, and I am participating on my own responsibility.
- I will inform a BST coach before the event starts if I have any condition relevant to my safe participation.
*Note: information disclosed here is sensitive personal/medical information under POPIA. BST must store it securely, limit access to relevant coaching staff, and not retain it longer than necessary for the event — see admin note at the bottom.*
### 4. Governing Law
This agreement is governed by the laws of the Republic of South Africa, and the parties submit to the jurisdiction of the South African courts.
### 5. Minors (participants aged 16–17)
I, the undersigned parent/legal guardian, confirm that I have read this entire waiver, consent to my child's participation in the Deadly Dozen Simulation, and agree to all terms herein — including the release of liability in Section 2 — on my child's behalf.
### 7. Acknowledgment
**I confirm that I have read this document in full, understand its contents including the release of liability in Section 2, had the opportunity to ask questions, and sign it voluntarily. I also confirm I have read and accept the companion "Terms of Participation" document, including its non-refundable entry fee policy.**
